1. Acceptance of Terms

By accessing, using, or interacting with the KOLscan platform (“Platform”, “KOLscan”), including any associated services, applications, websites, bots, Discord servers, Telegram channels, and any other official KOLscan properties (“Services”), you (“User”, “you”) acknowledge and agree to be legally bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not access or use any part of KOLscan.

2. Informational Purpose Only

All content, data, signals, alerts, dashboards, notifications, metrics, analytics, or other information provided by KOLscan (including via the web app, API, Discord, Telegram, Twitter, or any other official channels) is strictly for general informational and educational purposes only.

Nothing on KOLscan constitutes:

• Financial, investment, tax, or legal advice
• An offer, solicitation, or recommendation to buy or sell any asset or security
• Endorsement or guarantee of any crypto token, project, investment strategy, or third-party service

You are solely responsible for your own investment, trading, and financial decisions. Always do your own research (“DYOR”) and consult professional advisors as appropriate.

3. No Warranties, No Guarantees

KOLscan and its team, partners, contributors, and affiliates make no representations or warranties, express or implied, about the accuracy, completeness, reliability, or timeliness of any information provided.

All services and data are provided “as is” and “as available”, without warranty of any kind.

You use all KOLscan services entirely at your own risk.

4. KOLS Token and Access Control

KOLscan may restrict access to certain content or features (“Premium Content”) using one or both of the following methods:

• Token Gating: Only users holding a minimum threshold of KOLS tokens (ERC-20, on supported blockchains) in their own wallet may access selected features.
• Subscription: Users may purchase a time-limited subscription by sending a specified amount of ETH or supported assets to the designated payment wallet.

Holding KOLS tokens or paying for a subscription does not grant you any:

• Ownership, equity, voting rights, dividends, profits, or legal claim to KOLscan or its assets
• Rights to future value, returns, or benefits except time-limited access to features as specified

KOLS tokens are not an investment, security, or financial product, and KOLscan is not an exchange, custodian, or investment platform.

5. Payment & Subscription Terms

• Subscriptions are activated only after your payment is detected and confirmed by our system.
• Payments sent to any address other than the official payment address announced on the KOLscan website are not valid and will not be refunded or honored.
• Subscriptions are non-refundable and non-transferable.
• Subscription access may be revoked, suspended, or terminated at any time for violation of these Terms, suspicious activity, or at the discretion of the KOLscan team.

6. User Responsibilities

By using KOLscan, you agree that you will:

• Only access KOLscan using your own wallet and not impersonate or attempt to access another user's account
• Not use bots, scripts, or unauthorized automation to access or exploit the platform
• Not use KOLscan for any illegal, fraudulent, or malicious activity
• Not attempt to reverse engineer, scrape, exploit, or disrupt KOLscan services
• Comply with all laws, regulations, and tax obligations applicable in your jurisdiction

You are solely responsible for the security of your wallet, private keys, and funds. KOLscan never asks for your seed phrase or private keys.

7. Geographic & Regulatory Restrictions

KOLscan is not available in jurisdictions where use of cryptocurrency or access to web3 projects is prohibited by law.

You must not use KOLscan if you are a resident, citizen, or located in a country subject to relevant sanctions, embargoes, or where such use is otherwise illegal.

It is your sole responsibility to determine if you may legally use KOLscan in your location.

8. Third-Party Services

KOLscan may integrate with, or reference, third-party platforms, blockchains, wallets, analytics tools, and social networks.

KOLscan is not responsible for the availability, security, performance, or practices of any third-party services.

9. No Liability

To the maximum extent permitted by law:

• KOLscan, its team, contributors, partners, and affiliates disclaim all liability for any direct, indirect, incidental, special, consequential, or punitive damages, losses, lost profits, lost data, or other harm arising out of or related to your use (or inability to use) KOLscan, its data, or any associated services.
• You agree to indemnify and hold harmless KOLscan and its team from any claims, damages, liabilities, and expenses arising from your actions or use of the platform.

10. No Warranty of Availability or Continuity

KOLscan may update, suspend, modify, or discontinue any part of the platform at any time, with or without notice.

Access, uptime, and features are not guaranteed.

11. Staking via Virtuals Protocol

Staking KOLS tokens through the Virtuals Protocol does not provide any financial yield or guaranteed returns. Staking may grant reduced access requirements or loyalty points within the Virtuals platform, but these points have no cash value and do not represent a financial incentive.

KOLscan does not operate or control the staking mechanism and is not responsible for any losses or issues related to staking. Participation is at your own risk and for community engagement only.

12. Changes to Terms

These Terms may be updated or changed at any time, at the sole discretion of the KOLscan team. Continued use of KOLscan means you accept any changes.
